1. Acceptance of Terms

By downloading, installing, accessing, creating an account for, purchasing, or using mAI Coach, you agree to these Terms of Use. These Terms are a binding agreement between you and CT Labs LLC ("we," "us," or "our"). If you do not agree, do not use the App.

These Terms apply to the iOS app, Android app, website, backend services, APIs, community features, subscriptions, and related services. Our Privacy Policy is incorporated by reference.

2. Service

mAI Coach is an AI-powered fitness, nutrition, and recovery app for general wellness. It includes workout tracking, planning, recurring schedules, AI coaching and program generation, AI meal planning, barcode lookup, body weight and progress tracking, on-device bench press form analysis, HealthKit and Health Connect integrations, cloud sync, community features, accountability tools, research digests, push notifications, and subscription-backed premium features.

We may add, modify, meter, suspend, or discontinue features at any time, subject to applicable law and platform rules.

3. Eligibility and Accounts

You must be at least 18, or the age of majority in your jurisdiction if higher, to use the App. The App is not directed to children or teenagers under 18. Because Gemini-powered AI features are part of the App, you must not allow anyone under 18 to access AI coaching, workout generation, meal planning, photo or vision parsing, or other AI-powered features through your account or device.

You are responsible for your account credentials and all activity under your account. Deleting your mAI Coach account does not cancel App Store or Google Play subscriptions; you must cancel through the applicable platform.

4. Health, Fitness, and Nutrition Disclaimer

IMPORTANT: mAI Coach is a general wellness product. It is not a medical device and does not diagnose, treat, cure, mitigate, or prevent disease or medical conditions. It is not a substitute for a doctor, registered dietitian, physical therapist, mental health professional, certified trainer, or other qualified professional.

Exercise, strength training, dietary changes, and rehabilitation-style movements carry risks, including serious injury, illness, disability, or death. Consult a qualified healthcare professional before beginning an exercise or nutrition program, especially if you have injuries, medical conditions, pregnancy, eating-disorder history, medications, or other health concerns.

Calorie, macro, readiness, recovery, TDEE, and workout-load estimates are estimates only. AI-generated workouts, rehab suggestions, meal plans, grocery lists, and nutrition guidance may be wrong or inappropriate for you. You are solely responsible for deciding whether any recommendation is safe and suitable.

5. AI, Form Analysis, and Third-Party Data

The App's AI features use large language and vision models, including Google Gemini, and may produce inaccurate, incomplete, inconsistent, unsafe, or fabricated output. AI content is for informational wellness purposes only.

Bench press form analysis uses on-device pose estimation. It may be inaccurate and is not a substitute for in-person coaching. Camera frames for real-time form analysis are processed on device and are not stored or transmitted by that feature. Body-position processing may be considered biometric information under some laws, but we do not store or upload biometric templates from pose estimation.

Barcode nutrition data comes from Open Food Facts, a community-contributed database that may be incomplete or outdated. Always verify nutrition, ingredients, and allergen information from the physical product label before consuming food.

6. Subscriptions and Premium Features

mAI Coach offers optional auto-renewing subscriptions and premium features, including mAI Coach Pro. Premium Services may include higher AI usage limits, workout and meal-plan generation capacity, photo or vision parsing, community publishing, accountability tools, research digest access, extended analytics, restore-purchase functionality, and other features shown in the App.

Prices, billing periods, free trials, promotional offers, included features, and taxes are shown in the App and in the Apple App Store or Google Play purchase sheet before purchase. If there is a conflict, the platform purchase sheet controls.

Payments are processed by Apple or Google. We do not collect or store payment-card or bank-account credentials. RevenueCat manages purchase validation, restore purchases, entitlement status, renewal status, billing issues, grace periods, refunds or revocations, and subscription synchronization.

Subscriptions renew automatically unless canceled before the end of the current billing period. Cancel through Apple ID subscriptions or Google Play subscriptions. Cancellation takes effect at the end of the current billing period unless the platform grants a refund or revokes access. Refunds are governed by platform policy except where law requires otherwise.

Unused credits or limits do not roll over, have no cash value, and are not refundable unless required by law or platform policy. We may apply fair-use limits and anti-abuse controls to server-backed, AI, upload, and community features.

7. Community, Sharing, and Reddit

Community features are optional and may include profiles, avatars, shared programs, workout posts, comments, reactions, follows, accountability partners, challenges, training tips, reports, moderation tools, notifications, workout share links, and optional Reddit flair linking. You are responsible for content you publish and for choosing the audience for shared content.

You must not post content that is illegal, infringing, harassing, hateful, sexually explicit, exploitative, deceptive, spammy, privacy-invasive, unsafe, or otherwise objectionable, or content that includes another person's personal or health information without permission. Community content is not endorsed by CT Labs LLC and must not be treated as professional, medical, nutritional, legal, or safety advice.

We may use automated and manual moderation tools and may remove, hide, restrict, preserve, or report content; limit community access; or suspend accounts when needed for safety, abuse prevention, legal compliance, platform compliance, or enforcement of these Terms.

8. Your Content and Intellectual Property

You retain ownership of content you create or upload. You grant us a limited license to store, process, transmit, display, and moderate that content as needed to provide the App, operate sync and sharing features, enforce these Terms, and comply with law.

The App, exercise library, software, designs, algorithms, prompts, system instructions, trademarks, and other proprietary materials are owned by CT Labs LLC or its licensors. You may use the App only for personal, non-commercial wellness purposes unless we authorize otherwise.

If you believe content available through the App infringes your copyright, contact us with a DMCA notice identifying the work, the allegedly infringing content, your contact information, and the statements required by law. We may remove content and terminate repeat infringers in appropriate circumstances.

9. Privacy and Data

Our Privacy Policy explains what we collect and how we use it, including account data, workout and nutrition data, health data, AI requests, subscription entitlement metadata, push tokens, diagnostics, community content, Reddit link metadata, and crash reports. We do not sell your data, do not use health data for advertising, and do not collect advertising identifiers.

10. Third-Party Services and Platform Terms

The App relies on third-party services including Supabase, Google Gemini, Anthropic Claude, RevenueCat, Firebase Crashlytics, Firebase Analytics on Android, Google MediaPipe, Google ML Kit, Apple HealthKit, Google Health Connect, APNs, FCM, Reddit, Apple App Store, Google Play, and Open Food Facts. Your use of those features may also be subject to those providers' terms and policies. Apple and Google's platform terms govern platform billing, refunds, and subscription management. For the iOS App, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's platform rules.

For the iOS App, these Terms are between you and CT Labs LLC, not Apple. CT Labs LLC is solely responsible for the App, its content, maintenance and support, product claims, regulatory claims, privacy claims, consumer-protection claims, and intellectual-property infringement claims. Apple has no maintenance or support obligation. If the App fails to conform to an applicable warranty that has not been disclaimed, you may notify Apple and Apple may refund the purchase price to the extent required by Apple's terms, but Apple has no other warranty obligation to the maximum extent permitted by law. Your iOS license is limited to use on Apple-branded products you own or control, as permitted by Apple usage rules, including Family Sharing or volume purchasing where applicable.

11. Assumption of Risk, Warranties, and Liability

BY USING THE APP, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH EXERCISE, NUTRITION CHANGES, AI-GENERATED CONTENT, REHABILITATION-STYLE EXERCISES, FORM ANALYSIS, COMMUNITY CONTENT, AND OTHER FITNESS-RELATED FEATURES.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES REGARDING ACCURACY, SAFETY, EFFECTIVENESS, RELIABILITY, OR AVAILABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CT LABS LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, BODILY HARM, ILLNESS, OR DEATH ARISING FROM USE OF THE APP. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM OR $100.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold CT Labs LLC harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the App, your violation of these Terms, content you publish, your violation of law or third-party rights, or injury or harm resulting from exercise, nutrition, community, or AI recommendations you choose to follow.

12. Dispute Resolution

These Terms are governed by Oregon law, without regard to conflicts of law. The Federal Arbitration Act governs the arbitration provisions. Disputes must first be attempted through informal negotiation for 30 days. If unresolved, disputes will be resolved by final and binding arbitration administered by the American Arbitration Association, except either party may bring an individual claim in small claims court where permitted.

You may opt out of arbitration by emailing us within 30 days of first accepting these Terms with your full legal name, account email if any, and a clear statement that you wish to opt out of arbitration.

DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. ANY CLAIM MUST BE FILED WITHIN ONE YEAR AFTER IT ACCRUES OR IT IS PERMANENTLY BARRED.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the App, website, email, or platform-provided notices where appropriate. Continued use after the effective date of updated Terms means you accept the updated Terms.
